The below disclosure only applies if you (“You”) are a consumer (as defined by the Australian Consumer Law) and are receiving supply of services from Pegasus AI Pty Ltd (ABN 79 679 731 536) trading as Perci Health (“Perci Health”) within the state of New South Wales:
Before You enter into the agreement with Perci Health (“Agreement”), Perci Health draws Your attention to the following terms and conditions (in summary form) which are contained in the Agreement:
a. The Agreement automatically renews unless it is cancelled by You.
b. Perci Health excludes its liability to You for certain categories of loss or damage such as indirect or consequential losses, loss of data and loss of profits (among others).
c. Perci Health’s liability to You for direct losses is limited.
d. Perci Health may, in accordance with its Privacy Policy, provide personal information it collects from You to third parties in order to provide its service to You.
e. In certain circumstances Perci Health may unilaterally amend the terms of the Agreement upon the provision of 90 days’ notice to You.
f. You must indemnify Perci Health against claims, losses and damages caused by You in certain circumstances (such as where You breach obligations related to applicable laws or infringe the intellectual property rights of others).
g. Perci Health may suspend Your access to, or use of, its service under certain circumstances (such as where there is a breach of the Acceptable Use Policy or where there is a security threat to the Service).
